Microsoft had its day in court on Monday. The company is challenging longstanding legal standards and wants the burden of proof to be lowered to "preponderance of evidence" when disproving a patent.
Microsoft is currently arguing at the U.S. Supreme Court that the standard of proof is too high to disprove a patent in cases where the U.S. Patent and Trademark Office lacked prior art information. The U.S. Supreme Court is scheduled to hear oral arguments in the case on April 18, with a decision expected by the end of June.
i4i's brief before the U.S. Supreme Court argues that Microsoft is seeking to "lower the standard of proof" in patent cases in a way that "conflicts with over a century of judicial precedent."
The U.S. Patent and Trademark Office confirmed i4i's patent, sending another blow to Microsoft's legal strategy.
